Terms and Conditions

1. Introduction

Welcome to PublishNode. These Terms and Conditions ("Terms") govern your access to and use of the PublishNode platform, including our website, services, and applications (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Account Registration

To use certain features of PublishNode, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

3. Service Description

PublishNode is a content management system that enables users to:

  • Create and publish blog posts to WordPress sites
  • Process and optimize content using AI technology
  • Manage multiple WordPress sites from a single dashboard
  • Upload and publish content in bulk
  • Manage SEO metadata for published content

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

4. Subscription Plans and Billing

4.1 Subscription Plans

PublishNode offers multiple subscription plans with varying features and credit allocations:

  • Free Plan: 5 posts per month
  • Starter Plan: 50 posts per month at $10/month
  • Pro Plan: 200 posts per month at $20/month
  • Agency Plan: 1,000 posts per month at $40/month
  • Enterprise Plan: Custom pricing and unlimited posts

4.2 Billing

By subscribing to a paid plan, you agree to:

  • Pay all fees associated with your chosen subscription plan
  • Provide current, complete, and accurate billing information
  • Authorize automatic recurring charges to your payment method
  • Update your payment information promptly if it changes

4.3 Credit System

Credits are allocated monthly based on your subscription plan. Unused credits do not roll over to the next billing period. Credits are consumed when you publish posts to your WordPress sites. If you exceed your monthly credit allocation, you will need to upgrade your plan or wait until the next billing cycle.

5. Refund and Cancellation Policy

5.1 Consumer Right to Cancel

If you are a Consumer and unless the below exception applies, you have the right to cancel this Agreement and return the Product within 14 days without giving any reason. The cancellation period will expire after 14 days from the day after completion of the Transaction.

To meet the cancellation deadline, it is sufficient that you send us your communication concerning your exercise of the cancellation right before the expiration of the 14 day period.

5.2 How to Cancel Your Order

To cancel your order, you must inform Paddle of your decision. To ensure immediate processing, please contact us at hello@publishnode.com. Please note that in respect of subscription services your right to cancel is only present following the initial subscription and not upon each automatic renewal.

You also have the right to inform us using the model cancellation form below or by making any other clear, unambiguous statement through our available communication channels. If you use our contact form, we will communicate acknowledgment of receipt of your cancellation request to you without delay.

5.3 Effect of Cancellation

If you cancel this Agreement as permitted above, we will reimburse to you all payments received from you.

We will make the reimbursement without undue delay, and not later than 14 days after the day on which we are informed about your decision to cancel this Agreement.

We will make the reimbursement using the same means of payment as you used for the initial transaction and you will not incur any fees as a result of the reimbursement.

5.4 Exception to the Right to Cancel

Your right as a Consumer to cancel your order does not apply to the supply of Digital Content that you have started to download, stream or otherwise acquire and to Products which you have had the benefit of.

Important: If you have used PublishNode to publish posts to your WordPress sites during the 14-day cancellation period, you may not be eligible for a refund as you have benefited from the Service.

5.5 Refund Policy

Refunds are provided at the sole discretion of Paddle and on a case-by-case basis and may be refused. Paddle will refuse a refund request if we find evidence of fraud, refund abuse, or other manipulative behaviour that entitles Paddle to counterclaim the refund.

This does not affect your rights as a Consumer in relation to Products which are not as described, faulty or not fit for purpose.

5.6 Billing Errors

Refunds will also be issued in the following circumstances:

  • You were charged incorrectly due to a technical error on our part
  • You were charged after canceling your subscription (if cancellation was processed before the billing date)
  • You were charged for a subscription tier you did not authorize
  • Duplicate charges occurred due to a payment processing error

If you believe you have been charged in error, please contact us at hello@publishnode.com with your account details and transaction information within 7 days of the charge.

5.7 Subscription Cancellation vs. Refund

Canceling your subscription stops future charges but does not automatically entitle you to a refund for the current billing period, except during the 14-day cancellation period described above.

You will retain access to paid features until the end of your current billing cycle after cancellation.

6. Cancellation and Termination

6.1 Cancellation by User

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • You will retain access to paid features until the end of your current billing period
  • No refund will be provided for the remaining days in your billing period
  • Your account will automatically downgrade to the Free plan at the end of the billing period
  • Your data will be retained according to our Privacy Policy

6.2 Termination by PublishNode

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the Service in a manner that could harm PublishNode or other users.

7. Acceptable Use Policy

You agree not to use PublishNode to:

  • Violate any applicable laws or regulations
  • Infringe upon the intellectual property rights of others
  • Publish spam, malicious content, or illegal material
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Service or servers
  • Use the Service for any automated or bulk posting that violates WordPress.org terms
  • Resell or redistribute the Service without authorization

8. Intellectual Property

8.1 PublishNode Property

The Service, including its design, features, functionality, and content (excluding user-generated content), is owned by PublishNode and is protected by copyright, trademark, and other intellectual property laws.

8.2 User Content

You retain all rights to the content you create and publish using PublishNode. By using our Service, you grant us a limited license to process, store, and transmit your content solely for the purpose of providing the Service to you.

9. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. PUBLISHNODE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUBLISHNODE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PublishNode operates, without regard to its conflict of law provisions.
